Terms and conditions for commissions. 

 

Please read the following terms and conditions:

  A 50% non-refundable deposit is required for every painting. Your deposit is taken as accepting these terms. 

1. All artwork is original and created by the artist.

2. All copyright, media use and reproduction rights are all retained by the artist.

3. Any reproduction or similar use of the artwork must be agreed with the artist in advance.

4. Bookings are not confirmed until a non-refundable deposit is paid, (this will be included in the quotation).

5. Once completed, the artist will send an image of the completed work and an invoice for the outstanding balance. At this point the full payment is usually expected within 7 days. (if you require a longer period, up to 30 days to make the final payment, then this option can be discussed in the initial inquiry, however, the artwork can not be posted until final payments have been made).

6. If after 30 days payments have not been received, then the artist reserve the right to sell the original artworks and reproductions.

7. Quotes are valid for 30 days from the dates given.

8. The artist will try use their own photographs where possible or that of a photographer* , with their permission. If, however, you have asked for something the artist is not able to photograph or research themselves, then they will ask you to provide at least 3 photographs of your own in order for them to get an idea of what it is that you want in your artwork. In this case, providing photographs for your own piece of artwork in the understanding that the images are not copied, only used by the artist as they see fit to create a unique piece of artwork. Please make sure that they are clear images. Providing the photographs for your own artwork, you are also forgoing the photographers fee and will not receive royalties for the use of your photographs for your own artwork. When photographs are required, the artist will ask in writing, to avoid any confusion. If you send the artist any photographs that haven't been asked for, even if you think they may be a good subject to draw, and even if they then gets used to create a piece of artwork, then in this case you forgo your photographers fee and royalties. If you offer any photographs for free to be used by the artist for their artwork, then they remain free, you can not expect to receive royalties for use of the photographs afterwards. 

9. The artist has the right to refuse any work for any reasons, including, but not limited to pornography, drugs, violence and illegal or political views.

10. Clients are responsible for any /all custom charges and fees and other charges incurred from shipping or postage.

(* note, if a photographer is used for your artwork, then it's up to the artist to choose and pay for the photographer's fee as part of their research.)
